The photograph was first published in Libya in 1972, as documented by the cited source. Libya's Copyright Protection Law No. 9 of 1968 provides a general term of 25 years after the author's death, subject to a minimum of 50 years from first publication. It separately provides a 25-year term from publication for anonymous or pseudonymous works (Article 21), while the 5-year term for photographs applies only to photographic works limited to the "mere mechanical transmission of scenery" (Article 20). The file currently identifies the author as "Cyrene Magazine", but it does not establish that this photograph qualifies for the special 5-year photographic term. If the photograph was instead protected under the anonymous/pseudonymous or other applicable provisions, it would still have been protected in Libya on 1 January 1996. Libya's URAA restoration date is 1 January 1996. Under the URAA, foreign works that were still copyrighted in their source country on that date generally had their U.S. copyright restored. Therefore, if this 1972 photograph was still protected in Libya on 1 January 1996, it would not qualify as public domain in the United States merely because it later entered the public domain in Libya. In particular, if the 25-year anonymous-work term applies, the work would have remained protected until 1997, meaning it was still copyrighted in Libya on the 1 January 1996 URAA date. The U.S. copyright would therefore have been restored by the URAA. I therefore believe the file should be deleted unless evidence can be provided showing that the photograph qualified for the 5-year photographic exception, or otherwise establishing that it was already in the public domain in Libya on 1 January 1996.
